Discussion Seminar: Disciplinary authority in Administrative Law

The Administrative Law Research Group of the Universidad Externado de Colombia invites you to participate in the fifth session of its Discussion Seminar, in which Professor Jorge Iván Rincón Córdoba, director of the Administrative Law Department and research professor of the University, will present his most recent book: La potestad disciplinaria en el Derecho Administrativo (Disciplinary Power in Administrative Law), published in 2021.

In the text, Professor Rincón critically analyzes the growing tendency in our environment to postulate and defend an alleged autonomy of Disciplinary Law, based on the particularities presented in this field by the principles of criminality, substantial unlawfulness and culpability.

In his analysis, the author does not ignore the nuances of these guarantees; however, he refutes the premise of the alleged autonomy by placing the basis of the disciplinary power in Administrative Law, and specifically in the public employment regime, in the theory of organization and, above all, in the need to use general constructions of the legal regime applicable to the Public Administration, such as the theory of the administrative act and procedure, as well as the control exercised by the Contentious Administrative Jurisdiction over the decisions of the former.
